Idaho's mugshot law is one of the most unique in the country. There is no statewide law governing the release of mugshots, so it is up to each individual county to decide what to do with them. In some counties, like Ada and Canyon, the sheriff's office will release mugshots upon request. However, in other counties, like Boise and Elmore, the sheriff's office will only release mugshots if they are part of a criminal investigation.
This can create a lot of confusion for people who are trying to get their hands on a mugshot. If you don't know which county your loved one was arrested in, you may have a hard time getting their mugshot. The best bet is to contact the sheriff's office in the county where the arrest took place and see what their policy is.
Idaho Arrest Record Expungement
In Idaho, an arrest record can be expunged if the following conditions are met:
- The charges were dismissed, or the defendant was found not guilty.
- The defendant has not been convicted of a crime in the past 5 years.
- There is no current pending criminal case against the defendant.
- The defendant has not been required to register as a sex offender.
- The crime for which the defendant was arrested is not a serious offense, as defined by Idaho law.
If all of the above conditions are met, then the defendant can file a petition for expungement with the court. The court will then review the petition and decide whether or not to grant expungement.
